DVM® (Digital Video Marketing) is a division of MicroTech® Limited, a Christchurch based, privately owned, limited liability company.

Orders

Orders once placed cannot be cancelled, in whole or in part, without our prior approval. If an order is purported to be cancelled or varied after acceptance by DVM®, the Buyer must indemnify DVM® in full against all costs (labour and materials used) and expenses incurred in performing the contract to the time of cancellation or variation.

Prices

All quotations are subject to change or withdrawal at any time by DVM® without notice. All prices are quoted on the condition that the quantity of work quoted for will be carried out: DVM® has the right to review such prices if such quantity of work is not executed. The prices stipulated by DVM® and relating to this contract are based on rates, costs and conditions as at the date of order/quotation or materials, transport, labour, tax, insurance and other rate changes. All products delivered within New Zealand will incur 12.5% goods and services on all prices.

Payment

Payment on first orders will invariably be based on full payment at the time the order is placed. Subsequent orders will typically allow for some flexibility here and arrangements will be conducted to the mutual satisfaction of both parties.
Intellectual Property, Copyrights and Software Piracy

DVM® is committed to preventing theft of intellectual property. The Client warrants that they hold the legal rights to anything requested to be a part of any edited video material, including photos, logos, musical recordings, stock footage or any other materials delivered to DVM® for inclusion in the Client’s video and/or duplication orders. The Client agrees to indemnify and hold DVM® harmless for any loss, damage, or liability for infringement of any rights arising from the use or sale of material the Client hires DVM® to produce, edit, or duplicate. Material produced by DVM® including original and edited master videotapes, remain the physical and copyrighted property of DVM®.

Quality

DVM® make every effort possible to ensure the quality, integrity, and performance of all media duplicated by us. Only high quality media is used, and not only are quality controls applied at each stage of our duplication procedures, but a high proportion of completed media are sampled and tested at the end of the duplication run. For these reasons we have every confidence that the media supplied to you are of high performance and fault free.

However, because the performance of software and media is a function of the interplay between the two; the machine they are applied to; and to the operator, we cannot accept responsibility for the performance of media once they have been sold to your customers.

It is incumbent upon you as our client therefore to satisfy yourselves before onward shipment that your own standards have been met. If there is ANY quality shortfall, please contact us immediately, and steps will be put in hand forthwith to ensure you get what you have paid for, and we have promised.
DVD-R Compatibility

DVM®d uses the DVD-R recordable DVD format for its DVD projects. By ordering a DVD version of any service, you agree that DVM® will accept no responsibility if the DVD-R created will not play on your (or customers) DVD player because of compatibility problems. 98% of the DVD players on the market today will play DVD-R. These players are generally produced by the major manufacturers and are 100% DVD compliant.
